Carpet is cleaned after every tenant regardless how long you were there. There can be alot of dirt in 3 weeks just by walking on it.
It was clean when you got it, it gets cleaned at your expense when you leave.
Depending on where you live, this can be anywhere from kinda legal to crazy illegal.
Example…If you were in Ohio, there is case law that determines specifically that carpet cleaning is NOT legal unless it is for damage beyond normal wear and tear.
In nearly EVERY STATE….landlords can only charge for damages beyond normal wear and tear. Consult your state’s landlord tenant law, and look for something regarding charges like this.
Couple of other things to remember: Just because it is in your lease does not make it legal. You can write any damned thing you want on paper and sign it, date it, have it notarized…doesn’t matter if the law says it is illegal (consider, a written contract to kill a man…you can’t sue a hitman if he doesn’t follow through, as the contract was never legal). Also, even if your statute does not say explicitly, sometimes there is common law that determines the outcome.
Best thing to do is talk to an attorney…if you can’t afford one, call the local legal aid office. They handle civil cases only usually. If they can’t help, call a local Law school. They usually have resources.
Don’t believe any “14 year landlords” when it comes to deposits..they have generally become bitter from being landlords for so long…besides, I’ve met landlords that have been doing it wrong a lot longer than 14 years.
Well if you live in South Dakota like I do. My wife and I have that same problem. BEST ANSWER, look into the state law, as many state laws are different.
Do you really mean you’ve only lived there 3 weeks? How dirty can carpet get in that short amount of time? The bottom line is though, no matter how long you’ve lived there, if you don’t clean it when you leave, the landlord had every right to charge you.
